Welcome to FakeDoor!



These Terms and Conditions (“Terms and Conditions”), together with our Privacy Notice and Cookie Notice apply to your use of the FakeDoor Platform (the “Service”). Please read these Terms and Conditions carefully before using or registering to use the Service, as these terms will become a legally binding agreement between you and FakeDoor.

1. Definitions and Interpretations

Breach

failure by a Party to a contract to comply with one or more conditions of the contract.

Child

someone under the age of 18.

Entire Agreement

this written agreement is the complete understanding between the Parties. Any statement or promise made by a Party to the contract that is not in this written document will not be considered part of the legally binding contract.

General Certificate of Secondary Education.

Intellectual Property Rights

any and all copyright, rights in inventions, patents, know-how, trade secrets, trade marks and trade names, service marks, design rights, database rights and right in data, the right to sue for passing off, utility models, domain names and all similar rights, in each case whether registered or not.

Parties

refers to the contract between you and Fake Door Unipessoal Lda., registered in Portugal under company number 517 063 891, with its registered address at Rua Filipe Folque, 7, 3º Dto, Lisbon, Portugal. In These Terms and Conditions, references to “you” or “your” are references to you whether as a Visitor or User.

Personal Data

any information related to a natural person that can be used directly or indirectly to identify this person.

The Service

FakeDoor provides an immersive science education platform to help GSCE students prepare for Physics, Chemistry and Biology at the AQA, Edexcel and OCR exam boards.

Your Obligations

when you use the Service, you agree to abide by these Terms and Conditions. If you are a parent, you also confirm that you consent to the processing of your child’s personal data in accordance with our Privacy Notice and Cookie Notice.

2. Using the Service

2.1 Age Restrictions

Children under the age of 13 (or the minimum legal age required for consent for personal data processing in their country of residence) are not permitted to access or use the Service. However, if an individual who is above 13 and lives in a country which the age required for consent is higher, their usage of the Service can only be expressly authorised by a parent or legal guardian, who will consent to be bound by these Terms and Conditions.

2.2 Parents and Legal Guardians

If you are a parent or legal guardian and you allow a child to use this website or services, you are responsible for their actions on this platform. By giving approval, you agree to follow the rules of the service on behalf of the child. You agree to ensure the child uses the service according to these rules. FakeDoor may check to confirm your identity as a parent or guardian. However, FakeDoor cannot guarantee the accuracy of information provided by any user, including a child, and FakeDoor is not obligated to verify the identity of users or their claimed parent or legal guardian.

2.3 Access to the Service

Subject to your compliance with these Terms and Conditions, FakeDoor gives you a non-exclusive, limited, non-transferable, freely revocable license to access and use the Service for personal use. Each user must have a unique account, and you are responsible for any activity conducted on your account. You may not allow any other party to fully access or use the Service with your unique login, except where FakeDoor provides them with an account to have access to your progress reports.

2.4 Your Use of the Service

All usage rights granted to you are limited to private and personal use as part of and for the duration of the subscription of the Services. You are allowed to print one copy and download extracts of any page(s) from our website for your personal use. However, you cannot modify these materials in any way, and you must not use any illustrations, photographs, video or any graphics separately from accompanying text. You must always acknowledge our status as the content authors. You must not use any part of the content on our website for commercial purposes or for the purpose of training any artificial intelligence system, any machine learning model or programme, any large language model or similar model, in each case, without obtaining a licence from FakeDoor to do so. If you violate these Terms by scraping, copying, downloading or using any part of our website improperly, your right to use FakeDoor will immediately end. At our discretion, you will need to return or destroy any copies of the materials you have made and you could also become financially liable for any unauthorised use of the material.

2.5 Restrictions on Your Use of the Service

You are not authorised, by yourself or through any third party, to:
(i) rent, lease, sell, distribute, offer in a service bureau, sublicense, or otherwise make available the Service to any third party;
(ii) copy, replicate, decompile, reverse-engineer, attempt to derive the source code of, modify or translate any software parts of the Service;
(iii) access the Services for purposes of building or marketing a competitive product;
(iv) use FakeDoor’s materials in the provision of any other course or training;
(v) record on video or audio tape the lessons given at FakeDoor; use the Service to transmit unsolicited emails or engage in spamming;
(vi) use any form of data mining, extraction, or scraping on the Service and/or the contents available therein for machine learning or other purposes; or
(vii) bypass the measures we may use to prevent or restrict access to the Service, including without limitation features that prevent or restrict the use or copying of any content or enforce limitations on the use of the Service.

2.6 Content and Materials

The Service is not officially endorsed by the examination boards (AQA, Edexcel, OCR). Instead, all materials and content are meticulously created by accredited teachers who ensure it aligns with the openly accessible syllabus available on the internet for the respective examinations.

3. Payments and Subscriptions

3.1 Subscriptions and Renewals

If you are subscribing to FakeDoor, you can choose to pay every month or every year. Your subscription will keep renewing by itself, either every month or every year, depending on what you pick. You have the freedom to cancel your subscription whenever you want. But, if you do cancel, you might not get your money back for any charges that have already been made.

3.2 Taxes

Your subscription fees already include all taxes unless otherwise specified in an applicable invoice. Tax rates are calculated based on the billing information you provide and the applicable tax rate at the time of your subscription charge.

3.3 Free Trials

FakeDoor might offer you a two-week free trial (the “Free Trial”) to allow you to try our Services. FakeDoor reserves the right to set eligibility requirements and the duration of free trials. You can cancel your subscription access at any moment during the Free Trial period. Subsequent trials by the same user are not permitted.
After the Free Trial period ends, should you wish to continue to access the Service, you shall pay the subscription fees in accordance with the payment schedule and dates chosen.

3.4 Changes to Pricing

FakeDoor reserves the right to vary any fees for our subscriptions in advance of any purchase at our sole discretion. Any variation or amendment will be effective immediately upon posting on FakeDoor’s website.

4. Cancellation and Refunds

4.1 Cancellation

You can stop using the Service and/or cancel your subscription at any time via your account settings. If you cancel your subscription after 14 (fourteen) days of the first payment, you will not be entitled to a refund of any fees already charged.

4.2 Cooling off period

If you choose to cancel your subscription anytime within the first 14 (fourteen) days (the ‘cooling-off’ period) after you make the first payment, you will be entitled to receive a full refund, provided that you have not accessed 25% or more of the content of the course After this 14-days period, cancellation charges can be normally applied.

4.3 Refunds

FakeDoor will refund you using the same payment method you have chosen when you subscribed to FakeDoor. You will not be entitled to any refund or credits for any partial subscription period.

5. Privacy and Security

5.1 Information Security

FakeDoor employs strong security measures to safeguard information submitted to the FakeDoor Platform, aiming to prevent accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access. These measures are intended to match the risks and the nature of the information that they are protecting. Users bear responsibility for maintaining the confidentiality of their usernames and passwords.

5.2 Login Information

FakeDoor does not verify the identity of individuals using the platform, so FakeDoor cannot be responsible in cases where someone is using a User’s password without permission. Users must inform FakeDoor immediately via email (dataprotection@fakedoor.com) if that comes to their attention.

5.3 Data Transfers

FakeDoor commits not to share Users’ personal information with third parties without their consent unless compelled to do so by the applicable laws or lawful requests from regulatory or legal entities.

5.4 Data Privacy

FakeDoor’s Privacy Notice describes how FakeDoor collects, uses, shares, and stores your personal information. By creating a FakeDoor account, you confirm that you have read, understood and agree to our full processing of your personal data.

6. Intellectual Property

6.1 Service Content

You acknowledge and agree that all intellectual property rights on the Service, including but not limited to technology, source code, all content, software, scripts, images, 3D models, animations, texts, graphics, and audio shall remain the sole property of FakeDoor. You assign to FakeDoor any suggestions, ideas, enhancement requests, or other feedback you provide to FakeDoor relating to the Service. FakeDoor also owns all content, data, software, inventions, ideas and other technology and intellectual property that it develops in connection with the Service.

6.2 Trademarks

Nothing in these Terms and Conditions shall be construed as granting you any right or license to use any trademarks, service marks or logos displayed on the Service. You agree not to use or register any name, logo or insignia of FakeDoor for any purposes except with FakeDoor’s prior written consent and in accordance with any restriction required by FakeDoor.

6.3 Acceptable User Behaviour

You may display the content on the Service on a computer screen or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices.

6.4 Prohibitions

You may not reproduce, modify, copy, distribute or use for commercial purposes any of the materials or content on FakeDoor without a written authorisation from FakeDoor. Unauthorised copies of content found on the Service can lead to the termination of your subscription and further legal action. If in doubt, please contact legal@fakedoor.com.

6.5 Copyright Complaints

Fake Door respects the intellectual property of others. In case you have reasons to believe that someone has used your creative work without permission on FakeDoor, please send the following information to legal@fakedoor.com:
a) The exact copyrighted work that you believe it has been used without permission;
b) The specific part of FakeDoor that you are referring to, and why you think it is violating your copyright (including the full URL to access the content);
c) Your contact details (address, email address and telephone number)
d) A statement signed by you confirming that you genuinely believe that the use of this material is not authorised and that you are either the copyright owner or someone authorised to speak on their behalf;
e) A statement confirming that all this information is accurate and signing off with your signature (electronic signature is sufficient).

Once we receive this information, we will analyse it and if we conclude there is an infringement of any third-party intellectual property rights, we will remove such content from the Service. Otherwise, we will take any other necessary and suitable measures in accordance with the relevant laws.

7. Third-Party Services

FakeDoor might include links to third-party websites and content, which are the copyrighted work of its owners, who expressly retain all right title and interest in and to the third-party content, including, without limitation, all intellectual property rights therein and thereto. In addition to being subject to these Terms and Conditions, third-party content may also be subject to different and/or additional terms of use and/or privacy policies of such third parties. FakeDoor does not endorse, suggest or recommend the products or services of any third party.

8. Warranties

To the maximum extent permitted by law, the Service and all included content are provided on an “as-is” and “as-available” basis, without warranty of any kind that the Service or FakeDoor’s content is complete, accurate, secure or fit for a particular purpose. FakeDoor does not warranty that your Service will be uninterrupted or error-free.

9. Limitation of Liability

FakeDoor's liability will be limited to foreseeable damages arising due to a breach of material contractual obligations typical for this type of contract. FakeDoor offers the Service in good faith, but it is not liable for damages that result from a non-material breach of any other applicable duty of care. The use of FakeDoor's content and materials is at the users’ own risk and FakeDoor cannot be held liable for any loss, damage or injury suffered or incurred as a result. Particularly, FakeDoor cannot be liable for any accident with experiments at home or elsewhere, as these should not be repeated outside of the platform context. In addition, FakeDoor cannot be liable for users' grades, exam performance, career or lifetime earnings. These limitations of liability will not apply to any statutory liability that cannot be limited to liability for death, fraud or personal injury caused by our negligence or wilful misconduct, or to exclude our responsibility for something we have specifically promised you.

10. Term and Termination

10.1 Term

These Terms and Conditions shall take effect the first time you access the Service and will continue in full force and effect until:
i) if you are a paid subscriber, the expiration or termination of your subscription; or
ii) if you are using FakeDoor’s free trial when your account is deleted or terminated.

10.2 Termination for Convenience

FakeDoor may terminate the Service for its convenience at any time without liability to User, provided FakeDoor shall refund the unused prepaid fees.

10.3 Termination for Breach

Either party may terminate the Service for breach if:
i) the other party is in material breach of these Terms and Conditions or applicable subscription terms after providing written notice;
ii) the other party ceases its business operations or becomes subject to insolvency proceedings and the proceedings are not dismissed within 90 (ninety) days; or
iii) the other party is in material breach of these Terms and Conditions or the applicable terms of more than two times notwithstanding any solution of such breaches.

10.4 Effects of Termination

The termination of your subscription might have the following effects:
a) If FakeDoor terminates your subscription due to its own actions, FakeDoor shall refund any prepaid fees for the Service for the period beginning on the effective termination date through the end of your then-current subscription.
b) If your subscription is terminated due to a violation on your part, you will not receive any refund and shall immediately pay any outstanding fees for the remaining period of your subscription. FakeDoor might also take any necessary action to safeguard and protect its rights, namely to suspend or block access to and use of the Service, without the user being entitled to any compensation as a result.
c) Upon any expiration or termination of your subscription, you must cease using the Service.

10.5 Survival of Terms

Sections titled “Term and Termination”; “Payment and Subscriptions”, “Intellectual Property”; “Limitation of Liability”; “Miscellaneous” and “Applicable Law” shall survive any expiration or termination of these Terms and Conditions.

11. Changes to Terms and Conditions

FakeDoor reserves the right to change these Terms and Conditions at any time, with all changes posted online at the bottom of its website’s initial page. The latest version of these Terms and Conditions will prevail over any other version.

12. Applicable Law

12.1 Governing Law

These Terms and Conditions, your use and access to the Service, shall be governed by and construed in accordance with the laws of England and Wales. This choice of laws is applicable unless it denies a User the protections mandated by the laws of their habitual residence.

12.2 Complaints

Consumers have the option to submit complaints directly to FakeDoor at support@fakedoor.com

12.3 Legal Actions

Legal actions initiated by a User against FakeDoor regarding disputes arising from the contractual relationship fall under the jurisdiction of the competent court in Lisbon, Portugal. However, this provision does not restrict the User's right to file a lawsuit in any other legally permissible jurisdiction where they reside.

13. Miscellaneous

13.1 Changes to the Service

FakeDoor may add, change, or remove features or functionalities to the Service; modify or introduce limitations to storage or other features; or discontinue the Service altogether at any time. If you are on a paid subscription and FakeDoor discontinues the Service while you are still subscribed, FakeDoor will either switch you or make available to you a substantially similar service provided by FakeDoor (if available) and if it is unable to do so, FakeDoor will give you a refund for the part of the subscription that you have already paid for but will not be able to use due to the discontinuation of the service.

13.2 Severability

If any of these Terms and Conditions is found to be invalid or unenforceable, then to the extent and within the jurisdiction in which that term is invalid or unenforceable, it shall be severed and deleted from these Terms and Conditions and the remaining Terms and Conditions shall remain in full force and effect and continue to be binding and enforceable.

13.3 Assignment

All services provided by FakeDoor under these Terms and Conditions are personal to you and cannot be transferred or assigned to any other person. FakeDoor may freely transfer or assign any part of its rights or delegate its obligations under these Terms and Conditions.

13.4 Entire Agreement

These Terms and Conditions and our Privacy Notice set out the entire agreement between FakeDoor and you and replace any and all prior terms, conditions, warranties and/or representations to the fullest extent permitted by law.

13.5 No Waiver

Any delay or failure by FakeDoor to exercise any right it might have under these Terms and Conditions does not constitute a waiver by FakeDoor of that right.
